CLIMATE WIKIENCE LICENSE VERSION 0.1

THE SERVICE, SERVICE DATA, DERIVED DATA AND SERVICE RESOURCES ARE PROVIDED UNDER THE TERMS AND CONDITIONS OF THIS CLIMATE WIKIENCE LICENSE (“AGREEMENT”).

ANY USE INCLUDING WITHOUT LIMITATIONS REPUBLISHING, REDISTRIBUTION, COMMENTING, VIEWING, ACCESSING OF AT LEAST ONE OF THE FOLLOWING: THE SERVICE, SERVICE DATA, DERIVED DATA, SERVICE RESOURCES CONSTITUTES THE USER ACCEPTANCE OF THIS AGREEMENT.

1. DEFINITIONS

“User” means the entity that has any use including without limitations republishing, redistribution, commenting of at least one of the following: the Service, Service Data, Derived Data, Service Resources.

“Desktop Software” means including but not limited to software, documentation, files, or data available from Service web site (http://www.wikience.org) and its subdomain sites.

“Cloud Software” means the part of the Service including but not limited to software, documentation, files, or data that are provided by http://www.wikience.org

“Service” means Desktop Software and Cloud Software.

“Service Data” means third party data provided by the Service including but not limited to climate reanalysis data and satellite data obtained from Data Providers.“Derived Data” means the data obtained by processing Service Data including but not limited to results of calculations, screenshots, charts, trends as well as discoveries of certain phenomena or outliers.

“Data Provider” means any third party organization from which Service Data were obtained.

“Service Resources” means including but not limited to Service web site (http://www.wikience.org), its subdomain sites, Wikience Google Group, Wikience YouTube Channel, and Wikience Blog.

“Service Author” means, as individual or artificial body, any contributor to the Service development, maintenance, and documentation writing.

2. ACKNOWLEDGEMENTS

User agrees to acknowledge Climate Wikience and its authors in publications written with the use of the Service as:

Climate Wikience (http://www.wikience.org).

3. PUBLICITY RIGHTS

User grants Service Authors the right to include the User organization as a client in our promotional material. User can opt to have their name excluded from such use as agreed to in writing on a case-by-case basis by providing a sufficientlydetailed email request regarding the same to http://www.wikience.org/contact/ The subject line in such email should be entitled “Non-use of Subscriber Name.”

4. SERVICE RULES

a. User agrees not to engage in anyof the following prohibited activities: (i) copying,distributing, or disclosing any part of the Cloud Software in any medium,including without limitation by any automated or non-automated”scraping”; (ii) transmitting spam, chain letters, or otherunsolicited content via Service Resources; (iii) attempting to interfere with,compromise the Service integrity or security or decipher any transmissions toor from the computers, laptops or servers running the Service; (iv) taking anyaction that imposes, or may impose at our sole discretion an unreasonable ordisproportionately large load on our infrastructure; (v) collecting orharvesting any personally identifiable information, including account names,from the Service; (vi) impersonating another person or otherwisemisrepresenting your affiliation with a person or entity, conducting fraud,hiding or attempting to hide your identity; (vii) interfering with the properworking of the Service; (viii) accessing the Cloud Software through anytechnology or means other than Desktop Software; or (ix) bypassing the measureswe may use to prevent or restrict access to the Service, including withoutlimitation features that prevent or restrict use or copying of any content orenforce limitations on use of the Service or the content therein.

b. User agrees that it will not, directly or indirectly:reverse engineer, decompile, disassemble or otherwiseattempt to discover the source code, object code or underlying structure, ideasor algorithms of the Service; modify, translate, or create derivative worksbased on the Service (except Derived Data) or remove any proprietary notices,brandings, logos, legends or labels. User represents, covenants, and warrantsthat it will use the Service only in compliance with all applicable laws(including but not limited to policies and laws related to spamming, privacy(including but not limited to any European privacy laws), intellectualproperty, consumer and child protection, obscenity or defamation).

c. In connection with your use of the Service, we may send youservice announcements, administrative messages, and other information.

d. Using the Service does not give you ownership of any intellectualproperty rights in our Service or the Service Data. The Agreement does not grant youthe right to use any branding or logos used in the Service.

5. DISTRIBUTION OF DESKTOP SOFTWARE

User is granted non-exclusive, non-transferable, limited licensewithout fees to distribute the Desktop Software, provided that (i) you distribute theDesktop Software complete and unmodified, (ii) you do not distribute additionalsoftware intended to replace any component(s) of the Desktop Software, (iii)you do not remove or alter any proprietary notices, brandings, logos, legendsor labels contained in the Desktop Software, (iv) you only distribute the DesktopSoftware subject to a license agreement that: (a) is a complete, unmodifiedreproduction of this Agreement; or (b) protects Service Authors’interests consistent with the terms contained in this Agreement, and (v) youagree to defend and indemnify Service Authors from and againstany damages, costs, liabilities, settlement amounts and/or expenses(including attorneys’ fees) incurred in connection with any claim,lawsuit or action by any third party that arises or results fromthe use or distribution of Desktop Software.

6. NO WARRANTY

a. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.Each User is solely responsible for determining the appropriatenessof using the Service and assumes all risks associated with its exercise ofrights under this Agreement, including but not limitedto the risks and costs of Service errors,compliance with applicable laws, damage to or loss of data, programs orequipment, and unavailability or interruption of operations.

b. SERVICE AUTHORS MAKE NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, SPEED, PERFORMANCE, STABILITY, CORRECTNESS, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE SERVICE, ITS PARTS OR ANY DATA OR THEIR SEPARATE PIECES (INCLUDING BUT NOT LIMITED TO VISUALIZATIONS) THEREIN OR GENERATED THEREWITH. SERVICE AUTHORS DO NOT REPRESENT OR WARRANT THAT (A) THE USE OF THE SERVICE WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OROPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA, (B) THE SERVICE WILL MEET USER’S REQUIREMENTS OR EXPECTATIONS, (C) ANY SERVICE DATA OR DERIVED DATA WILL BE ACCURATE OR RELIABLE, (D) ERRORS OR DEFECTS WILL BE CORRECTED, OR (E) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. DISCLAIMER OF LIABILITY

a. ANY OF SERVICE AUTHORS SHALL HAVE ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS), HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY,WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THE SERVICE OR DISTRIBUTION OF THE DESKTOP SOFTWARE OR THE EXERCISE OF ANY RIGHTS GRANTED HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

b. ANY OF SERVICE AUTHORS SHALL HAVE ANY LIABILITY FOR THE CORRECTNESS OF VISUALIZATION, PROCESSING, TRANSMISSION, STORAGE AND OTHER FUNCTIONALITY PROVIDED BY THE SERVICE.

c. NEITHER ANY OF SERVICE AUTHORS NOR ANY OF DATA PROVIDERS SHALL HAVE ANY LIABILITY FOR UNEXPECTED, FALSE, WRONG, DISTORTED, BIASED OR MISLEADING CONCLUSIONS, OPINIONS, OUTCOMES, FINDINGS, DISCOVERIES OR CLAIMS (INCLUDING THOSE PUBLISHED ON THE SERVICE RESOURCES BY SERVICE AUTHORS OR OTHER USERS) THAT MAY BE BASED (EVEN PARTIALLY) WITHOUT LIMITATION ON SERVICE, SERVICE DATA AND/OR DERIVED DATA EVEN IF THOSE AROSE FROM ERRORS IN SERVICE FUNCTIONALITY OR ANY KIND OF SERVICE DATA AND DERIVED DATA DISTORTIONS, CORRUPTIONS OR ERRORS DURING THEIR PROCESSING, TRANSMISSION, VISUALIZATION, STORAGEINCLUDING ANY OTHER KIND OF SERVICE FUNCTIONALITY OR ANY KIND OF UNCERTAINTIES, INACCURACIES, BIASES, IMPERFECTIONS INITIALLY PRESENTED IN THE ORIGINAL DATA (OBTAINED AS IS FROM DATA PROVIDERS).

d. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SERVICE AUTHORS OR SERVICE USERS SHALLCREATE ANY WARRANTY OR LIABILITY NOT EXPRESSLY STATED IN THE AGREEMENT.

e. SERVICE AUTHORS SHALL HAVE ANY LIABILITY FOR ANY CONTENT (INCLUDING BUT NOT LIMITED TO DERIVED DATA, E-MAIL MESSAGES, MULTIMEDIA) POSTED ON SERVICE RESOURCES.

8. THIRD PARTY COMPONENTS

Additional copyright notices and license terms applicable to portions of the Desktop Software are set forth inthe THIRDPARTY.txt file accessible at http://www.wikience.org/THIRDPARTY.txt. In addition to any terms and conditions of any third party opensource/freeware license identified in the THIRDPARTY.txt file, the disclaimer of warranty and limitation of liability provisions in paragraphs 6 and 7 of the Agreement shall apply to all software contained in the Desktop Software.

9. USAGE STATISTICS

The Desktop Software may send someusage statistics to Cloud Software which will be used by Service Authors toimprove the performance of the Service. The usage statistics will containsolely technical information about the performance of the Service.

10. MODIFYING AND TERMINATING THE SERVICE

New features that augment or enhance the Service willbe subject to this Agreement. New features or limits can be added, created orremoved to/from the Service at any time without any notification. We maypermanently or temporarily terminate or suspend access of a User to the Servicewithout notice and liability for any reason, including if in Service Authorssole determination User violates any provision of this Agreement, or for noreason. Upon termination for any reason or no reason, User continues to bebound by this Agreement. The Service may be stopped or suspended at any timewithout any notification.

11. CHANGES TO THE AGREEMENT

a. This Agreement may be updated or changed at any time without any notification. When these changes are made,Service Authors will make a new copy of the Agreement available at http://www.wikience.org/licence.

b. You understand and agree that if you have any use including without limitations republishing, redistribution,commenting of at least one of the following: the Service, Service Data, Derived Data, Service Resources after the date on which the Agreement has changed, this will constitute your use as acceptance of the updated Agreement.
